A seventeen-year-old high school student with Down Syndrome choked to death during lunchtime in the school cafeteria. The parents of the child sued the school and several administrators, alleging negligence, wrongful death, and federal civil rights violations. The trial court granted summary judgment for Defendants. The Supreme Court reversed, holding (1) the trial court erred by granting Defendants’ motion for summary judgment on the issue of Plaintiffs’ compliance with the Indiana Tort Claims Act (ITCA) notice requirement, as material issues of fact remained as to whether Plaintiffs complied with the ITCA notice requirement; and (2) Plaintiffs’ state law claims for negligence and wrongful death were not ripe for summary judgment.
